Brand and label protection

What is brand and label protection?

Brand and label protection is a manufacturer or retailer requirement that damaged goods carrying their marks be destroyed or delabelled rather than resold. It constrains what can be recovered through salvage, so it must be identified during the inventory rather than discovered after a lot has been marketed.

Brand protection is a commercial requirement before it is a claims one. A manufacturer whose damaged product appears on a discount shelf has a warranty exposure, a safety exposure and a reputational one, so release for resale is frequently refused regardless of condition.

Where it is refused, the property is destroyed under documentation and no recovery is taken, or it is released only with labels removed under terms agreed in writing beforehand. Either way the decision is recorded against the claim rather than assumed.
